ST. PAUL, Minn. — Hundreds of people, some clutching candles or carrying flowers to lay in front of a memorial, gathered outside Minnesota’s Capitol on Wednesday evening for a vigil to remember a prominent state lawmaker and her husband who were gunned down at their home.

As a brass quintet from the Minnesota Orchestra played, Gov. Tim Walz wiped away tears and comforted attendees at the gathering for former House Speaker Melissa Hortman and her husband, Mark, who were killed early Saturday in the northern Minneapolis suburbs.

Colin Hortman, the Hortmans’ son, embraced Walz and lay a photo of his parents on the memorial.

The memorial, which sprang up outside the Capitol after the killings, features flowers, American flags, photos and sticky notes with such messages as, “Thank you for always believing in me and in Minnesota” and “We got this from here. Thank you for everything.”

Wednesday’s vigil also included a Native American drum circle, a string quartet and the crowd singing “Amazing Grace.”

Around the gathering, there was a heavy police presence, with law enforcement blocking off streets leading up to the Capitol and state troopers standing guard.

The event didn’t include a speaking program and attendees were instructed not to bring signs of any kind.

The man charged in federal and state court with killing the Hortmans, Vance Boelter, is also accused of shooting another Democratic lawmaker, Sen. John Hoffman, and his wife, Yvette, at their home a few miles away in Champlin. They survived and are recovering. Federal prosecutors have declined to speculate about a motive.

Boelter’s attorneys have declined to comment on the charges.

Hortman had served as the top House Democratic leader since 2017, and six years as speaker, starting in 2019. Under a power-sharing deal after the 2024 election left the House tied, her title became speaker emerita and Republican Rep. Lisa Demuth became speaker.

Walz has described Hortman as his closest political ally and “the most consequential Speaker in state history.”

The Hortmans were alumni of the University of Minnesota, which held a midday memorial gathering on the Minneapolis campus.

Rebecca Cunningham, the university’s president, spoke during the event about the grief and outrage people are grappling with along with questions about how things got to this point.

“I don’t have the answers to these questions but I know that finding answers starts with the coming together in community as we are today,” she said.

Funeral information for the Hortmans has not been announced.

MINNEAPOLIS — The man charged with killing a prominent Minnesota lawmaker and wounding another could face something that is a rarity for Minnesota but could become more common under the Trump administration: the death penalty.

Minnesota abolished capital punishment in 1911, and the state’s last execution was a botched hanging in 1906. But federal prosecutors announced charges against Vance Boelter on Monday that can carry the death penalty.

It’s not unheard of for state and federal prosecutors to both pursue criminal cases for the same offense, especially in high-profile matters.

In this case federal authorities essentially grabbed the lead from the state prosecutor, Hennepin County Attorney Mary Moriarty. Boelter had been scheduled to make his first court appearance on state charges Monday, but instead marshals took him from the county jail to the U.S. courthouse in St. Paul, where he appeared on the more serious federal charges.

Boelter is accused of fatally shooting former Democratic House Speaker Melissa Hortman and her husband, Mark, in their home early Saturday in the northern Minneapolis suburbs. Before that, authorities say, he also shot and wounded another Democrat, Sen. John Hoffman, and his wife, Yvette, who lived a few miles away. He surrendered Sunday night after what authorities have called the largest search in Minnesota history.

Two of the six federal counts can carry the death penalty, something federal prosecutors have not sought in a Minnesota-based case since the Supreme Court reinstated capital punishment in 1976.

“Will we seek the death penalty? It’s too early to tell. That is one of the options,” Acting U.S. Attorney Joseph Thompson said Monday at a news conference where he revealed new details of what he described as a meticulously planned attack. They included allegations that Boelter also stopped at the homes of two other lawmakers that night and had dozens of other Democrats as potential targets, including officials in other states.

Boelter’s federal defenders have declined to comment on the case, and he has not entered a plea.

On her first day in office in February, Attorney General Pam Bondi lifted a moratorium on federal executions that was imposed under the Biden administration in 2021. Only three defendants remain on federal death row after Biden converted 37 of their sentences to life in prison.

Bondi has since authorized federal prosecutors to seek the death penalty in at least three cases, including against Luigi Mangione for the killing of UnitedHealthcare CEO Brian Thompson. In the other two cases, the Justice Department has said it is seeking the death penalty against defendants charged with killing fellow prison inmates.

President Donald Trump’s first administration carried out 13 federal executions, more than the administration of any other president in modern history.

The federal intervention in Boelter’s case appeared to irritate Moriarty, the county’s former chief public defender, who was elected on a police reform and racial justice platform in 2022 after the police killing of George Floyd.

At a news conference Monday to announce the state charges, Moriarty gave only vague answers in response to questions about the interplay between the federal and state investigations. But she acknowledged “there’s a tension” and said federal officials “can speak for themselves.”

Moriarty said she intends to press forward in state court regardless and to seek an indictment for first-degree murder for the killings of the Hortmans, which would carry a mandatory sentence of life without parole. Her office did not immediately respond to a request for further comment Tuesday.

As evidence of the tensions, the county attorney refused to clarify how Boelter’ first hearings would play out. Court records show that Boelter was called for a first appearance in Hennepin County on Monday and that because he was not there as he was in federal custody, the judge issued a bench warrant as a formality, as requested by prosecutors.

“Usually murder cases are overwhelmingly handled in state courts,” said Mark Osler, a death penalty expert at the University of St. Thomas School of Law in Minneapolis. “Clearly this is something of national interest. And that seemed to play a role in the decision that the Justice Department is making here.”

Osler, who formerly served as Moriarty’s deputy county attorney and head of her criminal division, as well as assistant U.S. attorney in Detroit, acknowledged that there are often tensions between state and federal prosecutors.

“There’s no doubt that it’s complicated,” Osler said. “And it’s hard to avoid the sense of the older sibling grabbing something away from the younger sibling.”

If federal officials do pursue the death penalty, Osler said, they will face an unusual challenge: “a jury pool drawn from the citizens of a state that has rejected the death penalty for over 100 years. It’s not the same as choosing people in a state where there’s a history of support for the death penalty, such as Texas.”

After his federal court appearance, Boelter was taken to the Sherburne County Jail in suburban Elk River, where federal prisoners are often held.

Thompson told reporters that the federal case “does not nullify the state charges. They remain in place. … My expectation based on prior cases is the federal case, the federal charges, will be litigated first, but the state charges won’t necessarily go anywhere.”

Boelter’s next federal court appearance is June 27. He does not have any further appearances scheduled in state court.

“There’s a natural competitiveness that occurs sometimes between jurisdictions, but you have to hope that in the end, they’re all facing the same way where there’s something as important to public safety as this case is,” Osler said.

WASHINGTON — Members of Congress will attend emergency briefings this week after the murder of a Minnesota state lawmaker brought renewed fears — and stoked existing partisan tensions — over the security of federal lawmakers when in Washington and at home.

The suspect in the attack had dozens of federal lawmakers listed in his writings, in addition to the state lawmakers and others he allegedly targeted. The man is accused of shooting and killing former Democratic House Speaker Melissa Hortman and her husband, Mark, in their home early Saturday in the northern Minneapolis suburbs and wounding another lawmaker and his wife at their home.

The shootings come after credible threats to members of Congress have more than doubled in the last decade, the troubling tally of an era that has been marked by a string of violent attacks against lawmakers and their families.

In 2011, Democratic Rep. Gabby Giffords was shot and wounded at an event in her Arizona district. In 2017, Republican Rep. Steve Scalise was shot and wounded as he practiced for a congressional baseball game with other GOP lawmakers near Washington. In 2022, then-House Speaker Nancy Pelosi’s husband Paul was attacked in his home by a man who broke into their San Francisco home. And in 2024, two different men tried to assassinate Donald Trump during his presidential campaign.

All four survived, some with serious injuries. But those attacks, among others and many close calls for members of both parties, have rattled lawmakers and raised recurring questions about whether they have enough security — and whether they can ever be truly safe in their jobs.

“I don’t have a solution to this problem right now,” said Minnesota Sen. Tina Smith, a friend of Hortman’s who received increased security after the attack. “I just see so clearly that this current state of play is not sustainable.”

Connecticut Sen. Chris Murphy said lawmakers are “clearly at the point where we have to adjust the options available to us.”

The U.S. Capitol Police’s threat assessment section investigated 9,474 “concerning statements and direct threats” against members of Congress last year, the highest number since 2021, the year that the Capitol was attacked by Trump’s supporters after he tried to overturn his 2020 presidential election defeat. In 2017, there were 3,939 investigated threats, the Capitol Police said.

While members of Congress may be high-profile, they do have some resources available that might not be available to state and local lawmakers, said Sen. Mike Rounds of South Dakota, who was a member of the South Dakota state Senate for 10 years before he was the state’s governor. In the state legislature, “it just wasn’t feasible all the time” to have increased security, Rounds said.

As threats have increased, members of Congress have had access to new funding to add security at their personal homes. But it is unclear how many have used it and whether there is enough money to keep lawmakers truly safe.

“Resources should not be the reason that a U.S. senator or congressman gets killed,” Murphy said.

Instead of bringing lawmakers together, the Minnesota shootings have created new internal tensions. Smith on Monday confronted one of her fellow senators, Utah Republican Mike Lee, for a series of posts on X over the weekend. One mocked Minnesota Gov. Tim Walz, a Democrat who ran for vice president last year. Another post said of the murders, “This is what happens when Marxists don’t get their way.”

Friends and former colleagues interviewed by The Associated Press described Vance Luther Boelter, the man accused of assassinating Hortman and her husband, as a devout Christian who attended an evangelical church and went to campaign rallies for Trump. Records show Boelter registered to vote as a Republican while living in Oklahoma in 2004 before moving to Minnesota, where voters don’t list party affiliation.

Smith talked to Lee outside a GOP conference meeting as soon as she arrived in Washington on Monday. “I would say he seemed surprised to be confronted,” she told reporters afterward.

Senate Democratic Leader Chuck Schumer also called out Lee’s posts on the Senate floor, saying that for him to “fan the flames of division with falsities, while the killer was still on the loose, is deeply irresponsible. He should take his posts down and immediately apologize to the families of the victims.”

Lee’s office did not respond to a request for comment.

Lawmakers were already on edge before the shootings, which came less than two days after Democratic Sen. Alex Padilla was forcibly removed from a press conference with Homeland Security Secretary Kristi Noem in California. Officers restrained Padilla and put him on the ground.

Angry Democratic senators immediately took to the Senate floor Thursday afternoon to denounce Padilla’s treatment. “What was really hard for me to see was that a member of this body was driven to his knees and made to kneel before authorities,” said New Jersey Sen. Cory Booker. “This is a test. This is a crossroads.”

At the briefing Tuesday, Senate Democrats say they plan to ask security officials, as well as Republican leadership, about Padilla’s removal from the press conference as well as their protection against outside threats.

“I certainly hope to hear leadership responding in a profound way,” said New Mexico Sen. Ben Ray Lujan, a Democrat.

Sen. Tammy Baldwin, D-Wis., who said she had been informed that her name was also on the suspect’s list, said she wanted to hear recommendations at the briefing on how to improve security.

“And we can take those recommendations,” Baldwin said. “But I think, both with the president and his administration and with members of Congress, that we need to bring the temperature down. There’s no place for political violence ever. And the rhetoric — words matter.”
