An attorney representing the families of the Robb Elementary School mass shooting victims confirmed to ABC News on Tuesday night that a settlement was reached and approved by a unanimous vote at a city council meeting in Uvalde, Texas.

Josh Koskoff, one of the attorneys who filed the lawsuit against the city, did not specify the exact terms of the settlement.

The lawsuit responds to the circumstances surrounding the school shooting that took place on May 24, 2022, claiming the lives of two teachers and 19 students.

In addition to a monetary settlement that would be paid out by the city’s insurance, the families were asking for Uvalde Police to adopt new fitness standards for the force and boost officer training, attorneys announced at a press conference in May 2024.

At the time of filing the suit, Koskoff told ABC News that the plaintiffs also were asking the city to maintain the cemetery where many of the victims are buried and to provide an updated accounting of the donations and spending related to May 24.

The plaintiffs were also asking to designate May 24 as an official day of remembrance in Uvalde and to create a committee for a permanent memorial in town.

The attorney confirmed all 21 victims’ families were represented in the lawsuit, but didn’t disclose any others who are listed as plaintiffs.

Secretary of State Marco Rubio on Tuesday unveiled a sweeping plan to dramatically restructure the State Department that would see many of its longstanding offices and hundreds of positions eliminated.

“In its current form, the department is bloated, bureaucratic, and unable to perform its essential diplomatic mission in this new era of great power competition,” Rubio said in a statement. “The sprawling bureaucracy created a system more beholden to radical political ideology than advancing America’s core national interests.”

Officials familiar with the plans say Rubio’s vision involves reducing the number of offices within the State Department from 734 to 602 and eventually wiping out roughly 700 Washington-based positions for Foreign Service and Civil Service employees.

The officials said that the reductions would not be immediate, and that leaders within the department would have 30 days to analyze and implement the plan.

An updated organizational chart released by Rubio shows offices on the chopping block include those that fall under the department’s Bureau of Energy Resources and its Bureau of Conflict and Stabilization Operations, which is aimed at helping the federal government “better anticipate, prevent, and respond to conflict,” according to the department.

Other offices that would be eliminated under the plan include the Office of the Science and Technology Advisor to the Secretary, the Office of International Religious Freedoms, the Office to Monitor and Combat Trafficking in Persons, the Office of Global Women’s Issues, the Office of Global Partnerships, and the Office of Global Criminal Justice, which is aimed at coordinating the government’s response to war crimes and promoting accountability for offenders.

Under the plan, the department will also combine two bureaus focused on arms control and eliminate units focused on countering violent extremism from the department’s counterterrorism bureau.

Officials also expect that several special envoys and their offices will be eliminated.

State Department spokesperson Tammy Bruce said that reorganization did not necessarily mean that the area of focus previously covered by an eliminated office was no longer a priority for the department.

“Certainly, all these issues are important,” Bruce said, adding that department would work at “blending” those topics within the new framework so they could be “dealt with as a whole.”

However, officials say that other reductions are planned for areas in the department that were not directly impacted by the reorganization, and that undersecretaries throughout the bureau have been instructed to draw up plans to reduce their personnel by 15% — a move that could lead to thousands of additional job cuts.

State Department leadership has been under increased pressure to reduce its workforce amid broader cuts across the federal government spearheaded by Elon Musk and his Department of Government Efficiency (DOGE).

On Tuesday, Bruce downplayed the role DOGE had in the reorganization plans.

“We know the American people love the result of DOGE. I think there were some questions, perhaps, about how it was applied,” she said.

“I would say that DOGE is not in charge of this, but this is the result of what we’ve learned and the fact that we appreciate results,” Bruce added.

The Trump administration has been considering a budget proposal that would cut the State Department’s budget by roughly half, according to officials familiar with internal deliberations and documents reviewed by ABC News.

Rubio’s restructuring doesn’t address the department’s overseas operations, which officials say are also likely to undergo significant cuts in the coming months.

An Arizona jury has reached a verdict in the latest trial of Lori Daybell, the mother convicted of murdering two of her children in a so-called doomsday plot who is now accused of conspiring with her brother to kill her fourth husband.

The jury was handed the case Monday afternoon before reaching a verdict Tuesday afternoon.

The verdict is expected to be read in 30 minutes.

Lori Daybell, 51, represented herself in the Phoenix trial. She did not take the stand or call any witnesses.

Dubbed the “doomsday mom,” Lori Daybell has maintained that her brother shot her then-husband of 13 years, Charles Vallow, in self-defense in her home in Chandler, Arizona, in July 2019. Her brother, Alex Cox, died from natural causes months after the shooting.

Prosecutors, meanwhile, said the shooting was a ploy for Daybell to get rid of her estranged husband so she could get his $1 million life insurance policy and be with her current husband, Chad Daybell, whom she married four months after the shooting. Prosecutors further said she invoked their religious beliefs as justification for the murder and gave her brother “religious authority” to kill Vallow because they believed he was possessed by an evil spirit they referred to as “Ned.”

Lori Daybell pleaded not guilty to conspiracy to commit first-degree murder.

Both Lori and Chad Daybell were found guilty of first-degree murder for the deaths of her children, Joshua “J.J.” Vallow, 7, and Tylee Ryan, 16, who went missing months after Charles Vallow was killed. In separate trials in 2023 and 2024, prosecutors argued the couple thought the children were possessed zombies and murdered them so that they could be together. The children’s remains were found on an Idaho property belonging to Daybell in June 2020 following a monthslong search.

Lori Daybell is currently serving life in prison without parole for the murders of her two children. She has denied killing them.

Chad Daybell was sentenced to death after being convicted of murdering the two children, as well as his first wife, Tamara Daybell, and now awaits execution on Idaho’s death row.

With more than 61 million Catholics and the second-highest number of cardinals after Italy, the United States is primed for the question of whether an American pontiff is possible in the wake of Pope Francis’ death on Monday.

Francis, a Jesuit from Argentina who died in the early hours of Monday at age 88, after 12 years as leader of the Roman Catholic Church, was the first non-European pope in nearly 1,300 years.

The United States has 17 cardinals, 10 of whom are eligible to vote in the election of the next pope, according to the Vatican. The country with the most cardinals is Italy, which has 51, including 17 eligible to vote for the next pontiff, according to the Vatican.

The United States has 61.9 million Catholics, representing about 19% of the total population, according to the most recent U.S. Religion Census conducted in 2020 by the Association of Statisticians of American Religious Bodies.

Even though the U.S. has one of the largest Catholic populations in the world, some experts told ABC News that the likelihood of the next pontiff coming from America is a long shot.

Anne Barrett Doyle, co-director of BishopAccountability.org, a watchdog group that tracks clergy child abuse cases in the Catholic Church worldwide, told ABC News that if an American were selected as pope, it could be perceived as “overwhelming,” given the United States’ global dominance already.

“If the Catholic Church were also run by an American, the global dominance of the U.S. would be simply pervasive and overwhelming,” said Barrett Doyle.

Technically, any man baptized in the Catholic Church can become pope, according to the Vatican. But popes are typically chosen from the College of Cardinals. Only cardinals under the age of 80 are allowed to participate in electing a pope.

Cristina Traina, a religious studies professor at Fordham University, told ABC News that several U.S. cardinals have been floated as possible successors to Francis.

“I think it’s unlikely because the American church is seen as contentious at this moment,” Traina said of the prospect of an American being chosen as the next pope. “So, I think they are much more likely to go either for a European or someone from the global south or Asia.”

Traina, however, said Cardinal Joseph Tobin, the archbishop of the Archdiocese of Newark, New Jersey since 2017, has emerged as a possible candidate.

The 73-year-old Tobin was named by Pope Francis to the College of Cardinals in 2016 to serve as the Archbishop of Indianapolis, after Pope Benedict XVI appointed him in 2012, according to his biography on the New Jersey Catholic Conference website.

Tobin previously served in several positions in the Catholic Church, including pastor of St. Alphonsus Parish in Chicago and General Consultor of the Community of Rome and Superior General of Redemptorists in Rome, according to his biography.

In a statement released Monday on the passing of Pope Francis, Tobin said, “He was a man of deep faith, profound humility, unshakable hope — a servant whose tireless call to care for the poor and marginalized will continue to inspire the Church for generations to come.”

Another American cardinal who has been mentioned as a possible successor to Francis is Cardinal Robert Prevost. The 69-year-old Chicago-born Prevost was the only U.S. cardinal included on a shot list of front-runners for pope, also known as “papabiles,” compiled in the aftermath of Francis’ death by the Associated Press.

Since 2023, Prevost has held the position at the Vatican as Prefect of the Dicastery for Bishops, in charge of vetting nominations for bishops around the world, according to his profile on the Vatican Press Office website. Francis brought Prevost to work at the Vatican after first appointing him in 2014 to serve as the bishop of Chiclayo, Peru. Prevost is also president of the Pontifical Commission for Latin America.

Dr. Miles Pattenden, a historian of the Catholic Church and a lecturer of history at Oxford University in England, also told ABC News that the prospect of an American pope this time around is “very unlikely.”

Pattenden noted that Pope Francis had a history of clashing with the Trump administration — going back to Trump’s first term in office, when he criticized building of U.S.-Mexico border wall, saying, “A person who thinks about building walls, wherever they may be, and not building bridges, is not Christian.”

In a public letter to U.S. Catholic bishops in February, Pope Francis described the mass deportation crackdown ordered by President Donald Trump’s administration as a “major crisis.”

“There has traditionally been a lot of wariness about a pope from the Anglosphere,” Pattenden said. “I shouldn’t think that the current circumstances change that, especially now with the tensions between the Vatican and the Trump administration.”

Trump said on Monday that he and first lady Melania Trump plan to travel to Rome to attend Pope Francis’ funeral.

“I just signed an executive order putting the flags of our country, all of them, all federal flags, and state flags, at half-mast in honor of Pope Francis,” Trump said at the White House. “So, he was a good man. Worked hard. He — he loved the world.”

NEW YORK — A jury concluded Tuesday that The New York Times did not libel former Alaska Gov. Sarah Palin for an error in a 2017 editorial that she says damaged her reputation.

The jury deliberated a little over two hours before reaching its verdict after lawyers for Palin and the newspaper delivered closing arguments at a Manhattan federal court civil trial that is in its second week.

Palin testified Monday that death threats against her increased and her spirits drooped after an editorial about gun violence said her political action committee had contributed to political rhetoric that enabled an atmosphere of violence.

The Times corrected the article less than 14 hours after it was published.

Kenneth Turkel, an attorney for Palin, urged the jury to find the Times liable for defamation on the grounds that its former editorial page editor, James Bennet, either knew what he was publishing was wrong or acted with “reckless disregard” for the truth.

He told the jury it should award Palin compensatory damages for the harm done to her reputation and private mental anguish, adding that they should “find a number and let her get some closure to this thing.”

“To this day, there been no accountability,” he said. “That’s why we’re here.”

He told jurors not to be deceived by Palin’s “bouncy” persona on the witness stand.

“She doesn’t cry a lot,” Turkel said. “It may have been to them an honest mistake. For her, it was a life changer.”

Palin, who earned a journalist degree in college, sued the Times for unspecified damages in 2017, about a decade after she burst onto the national stage as the Republican vice-presidential nominee.

Her lawsuit stemmed from an editorial about gun control published after U.S. Rep. Steve Scalise, a Louisiana Republican, was wounded in 2017 when a man with a history of anti-GOP activity opened fire on a Congressional baseball team practice in Washington.

In the editorial, the Times wrote that before the 2011 mass shooting in Arizona that severely wounded former U.S. Rep. Gabby Giffords and killed six others, Palin’s political action committee had contributed to an atmosphere of violence by circulating a map of electoral districts that put Giffords and 19 other Democrats under stylized crosshairs.

In a correction, The Times said the editorial had “incorrectly stated that a link existed between political rhetoric and the 2011 shooting” and that it had “incorrectly described” the map.

A tearful Bennet apologized to Palin from the witness stand when he testified last week, saying he was tormented by the error and worked urgently to correct it after readers complained to the newspaper.

Felicia Ellsworth, an attorney for the Times, said the jury cannot find the newspaper or Bennet liable because it would have to conclude that the error was intentionally published by editors who knew it was wrong.

“There’s not been one shred of evidence showing anything other than an honest mistake,” she said.

Ellsworth said Bennet and the Times “corrected the record loudly, clearly and quickly” once the error was discovered.

The lawyer pointed out that several Times editors testified consistently about the effort to correct the error and the importance they placed on accuracy while Palin’s claims were “supported by nothing other than her say so.”

And she noted that Palin’s status as a public figure meant that the jury would have to find “actual malice” to find in her favor.

“To Governor Palin, this is just another opportunity to take on fake news. To James Bennet, the truth matters,” Ellsworth said.

In February 2022, Judge Jed S. Rakoff rejected Palin’s claims in a ruling issued while a jury deliberated. The judge then let jurors deliver their verdict, which also went against Palin.

The trial is occurring after the 2nd U.S. Circuit Court of Appeals in Manhattan restored the case last year.

The appeals court said Rakoff’s dismissal ruling improperly intruded on the jury’s work. It also cited flaws in the trial, saying there was erroneous exclusion of evidence, an inaccurate jury instruction and a mistaken response to a question from the jury.

The Trump administration’s plan to begin collecting defaulted college loan payments from millions of borrowers risks contributing to an economic slowdown at a time when the U.S. faces an elevated risk of a recession, some experts told ABC News.

Roughly 5 million borrowers will have their loans sent for collections beginning on May 5, the U.S. Department of Education, or DOE, said this week. Another 4 million people are in late-stage delinquency, meaning they could face collections within a matter of months.

Under the plan, the federal government will garnish wages from some of those borrowers, pulling money out of their pockets that may otherwise be spent and in turn drying up some economic activity, the experts said.

If the economy spirals into a downturn, they added, that lost spending would likely have been a smaller factor than other issues like tariffs and investor jitters, but the student-loan collections could compound the damage.

“The bottom line is: it’s not going to be good for the economy, given the current economic situation that’s already precarious,” said Scott Imberman, a professor of education policy at Michigan State University. “It’s an additional weight that you’re putting on until we tip into a potential recession.”

In all, some 42 million borrowers owe more than $1.6 trillion in student debt, according to the DOE.

If the borrowers currently in late-stage delinquency were to default on their own loans, it would bring the share of borrowers in default to nearly 25%.

The resumption of collections on defaulted student loans lifts a pause initiated in 2020 at the onset of the COVID-19 pandemic. Within weeks, millions of borrowers will need to begin repayment.

“The scale is quite large,” Michael Jones, an economist at the University of Cincinnati, told ABC News. “Every dollar that goes to pay the loans is a dollar that won’t be circulated into the economy.”

Consumer spending accounts for roughly 70% of U.S. economic activity. Potential downward pressure from student loan repayments comes as surveys show sour consumer sentiment in the face of potentially rising inflation and slowing growth.

The debt collections could also damage the credit score of many borrowers, since scoring systems are typically alerted when collections ensue, experts said. In such cases, they added, borrowers will face greater difficulty making big-ticket purchases like homes and cars for which they will need to take out a loan.

“Those individuals will not qualify for the auto loan they otherwise would’ve been able to purchase,” Jones said. “That can cause a drop in vehicles being sold.”

Brent Evans, professor of public policy and higher education at Vanderbilt University, acknowledged a heightened level of economic uncertainty but cautioned against alarm over the added risk posed by the student loan collections.

“The uncertainty in the economy is near an all-time high,” Evans said. “That’s a broad concern and therefore it’s very difficult to predict the impact of any one of these levers.”

Since the federal government will only claw back defaulted debt from wages or programs such as Social Security, the policy will not impact all defaulted borrowers, Evans noted.

“It’s clear that it means less money in people’s pockets, but it might not be that much money for these borrowers,” Evans said.

Student-loan collection will be paid to the U.S. Treasury, adding to government revenue and potentially easing a fraction of the nation’s $36 trillion debt.

“American taxpayers will no longer be forced to serve as collateral for irresponsible student loan policies,” U.S. Secretary of Education Linda McMahon said in a statement on Monday. “The Biden Administration misled borrowers: the executive branch does not have the constitutional authority to wipe debt away, nor do the loan balances simply disappear.”

While the policy may reduce income for some borrowers, it clarifies the path forward for loan payments after years of uncertainty surrounding the Biden administration’s efforts to forgive loans, Jones said.

“It is short-term pain but it actually brings certainty,” Jones added. “It gives clarity for decisions these borrowers need to make about their future.”

“When the economy was booming a few years ago, these payments could’ve been reintroduced then,” Jones said. “It’s unfortunate timing now when the economy is looking at a potential recession. But it’s probably time to rip the Band-Aid off.”

Disgraced former Rep. George Santos, R-N.Y., insists he has “accepted full responsibility” for a series of fraudulent schemes despite a “social media blitz” that federal prosecutors said suggested otherwise.

Prosecutors repeated their request for a prison term of more than seven years when Santos is sentenced Friday, saying his recent social media posts show the 35-year-old Santos “remains unrepentant for his crimes.”

Santos, in a letter to the judge Tuesday, said he can be both “profoundly sorry” and upset by the Justice Department’s recommendation of a lengthy prison sentence.

“But saying I’m sorry doesn’t require me to sit quietly while these prosecutors try to drop an anvil on my head. True remorse isn’t mute; it is aware of itself, and it speaks up when the penalty scale jumps into the absurd,” Santos’ letter said.

“Ironically, the same political ambition that underpinned my own wrongdoing now seems to fuel the government’s overreach in this case,” hew wrote. “You’d think they might have learned something from the very person they chose to prosecute so vehemently!”

Santos included a selective chart to suggest the government’s sentencing recommendation is out of step with other political prosecutions, citing former Illinois Rep. Jesse L. Jackson Jr. being sentenced to 30 months for misusing $750,000 in campaign funds or ex-New York Rep. Michael Grimm being sentenced to eight months for concealing $900,000 in wages and taxes.

Prosecutors alleged Santos, with the help of former Campaign Treasurer Nancy Marks, falsified Federal Election Commission filings, fabricating donor contributions and inflating fundraising totals to meet the $250,000 threshold required to join the National Republican Congressional Committee’s coveted “Young Guns” program. Marks pleaded guilty and is awaiting sentencing in June.

When informed he hadn’t reached the NRCC benchmark, Santos texted an associate, “We are going to do this a little differently. I got it.”

The “different” approach included submitting fake donations attributed to family members, fictitious individuals and even identities stolen from elderly supporters, according to the filing.

Santos pleaded guilty to wire fraud and aggravated identity theft in August 2024. He had already been expelled from Congress in December 2023.

Michigan is set to face a competitive primary and fierce race for the battleground state’s open U.S. Senate seat in 2026.

Three major Democrats have already entered the contest, while Republicans eye flipping the seat, which will be vacated by retiring Sen. Gary Peters, D-Mich.

The battleground state had mixed results for both parties in 2024, with President Donald Trump snagging a win in the presidential race and then-Rep. Elissa Slotkin, a Democrat, prevailing in the Senate race. Democrats hope to keep the open seat in their hands, while Republicans hope to flip it and add to their majority in the Senate.

Rep. Haley Stevens, a Democrat who represents Michigan’s 11th District, revealed on Tuesday that she will run for Senate, with an announcement focused on the state’s automobile industry and how it may be affected by tariffs imposed by the White House.

“Growing up in Michigan meant being surrounded by innovation, ingenuity and pride in hard work. And from our farmers to our nurses to our manufacturers, Michigan has the best workers in the world,” Stevens said in an announcement video posted on social media on Tuesday.

“But Donald Trump has a much different plan for Michigan,” she added.

“His chaos and reckless tariffs are putting tens of thousands of Michigan jobs at risk,” she said, adding that costs are rising “but all we’re getting is more chaos. What the heck are they doing?”

Stevens, first elected to the House in 2018, is a member of the House Education and Workforce Committee and the House Science, Space and Technology Committee. She also served as chief of staff of the Presidential Task Force on the Auto Industry during the Obama administration.

In 2022, she endured a competitive member-on-member primary against then-Rep. Andy Levin, although she was bolstered by outside support from pro-Israel groups. (The U.S.-Israel relationship is a hot-button issue in Michigan and became a wedge issue during the 2024 elections.)

She is set to face a competitive Democratic primary, which includes two other high-profile figures. (One key name took himself out of contention already: Former Transportation Secretary Pete Buttigieg ruled out a Senate bid in March.)

Abdul El-Sayed, the former director of the Wayne County, Michigan, health department and a former Michigan gubernatorial candidate, announced on Thursday he will run for the seat — and he netted a quick endorsement from Sen. Bernie Sanders, I-Vt.

“I’m running for U.S. Senate because in the state that built the ‘American dream,’ it shouldn’t be this hard just to get by,” El-Sayed said in an announcement video that opened with a fictional, old-style cartoon talking about his background.

“We’ve got to fight back hard against Trump and [Elon] Musk with a hell of a lot more than paper paddles and broken promises. … The disease is the corruption of our politics by billionaires and corporations, while the workers who built this country are forgotten,” he added in the announcement in clips that appear to be from a podcast taping.

Sanders, who has received renewed national attention in recent months as he attracts crowds on his nationwide “Fighting Oligarchy” speaking tour, endorsed El-Sayed the same day.

Earlier in April, Michigan state Sen. Mallory McMorrow announced her own Senate bid.

In an announcement video, which opened with a montage of news clips about Trump and a clip of Musk’s viral moment in February holding a chainsaw, McMorrow said, “There are moments that will break you. This is not that moment. This moment will challenge us, test us. And if it all feels like too much? That’s they’re plan. They want to make you feel powerless. But you are not powerless.”

McMorrow entered the national spotlight after being baselessly accused of aiming to “groom and sexualize kindergartners” in a 2022 fundraising email sent out by a fellow state senator. She struck back in a now-viral floor speech, saying, “I am the biggest threat to your hollow, hateful scheme.”

In her announcement video, McMorrow framed the Trump administration as creating a fearful moment in time and said new leaders are needed — echoing a debate within the Democratic Party about whether it needs generational change at the top of the party.

“There’s a lot of fear and anger and uncertainty right now about people in power who frankly have no business being there. So you know what won’t fix it? The same old crap out of Washington,” McMorrow said, “We need new leaders because the same people in D.C. who got us into this mess are not going to be the ones to get us out of it.”

On the Republican side, the primary is still taking shape, but one major name has entered the fray.

Former Rep. Mike Rogers, who ran for Senate in Michigan in 2024 and narrowly lost to Slotkin, announced in mid-April that he would enter the race.

“The lessons I learned working on a factory floor, serving as an officer in the United States Army, and then as a federal agent protecting our communities, taking down drug dealers and gangsters — it taught me about grit and sacrifice,” Rogers said in an announcement video.

“I’ll stand with President Trump,” he added. “And we will deliver on the mandate given to him by the American people. … For me, it will always be America and Michigan first.”

Rogers also spoke about cutting costs and prices while bringing manufacturing jobs back to Michigan.

“I guarantee we’ll protect Social Security for our seniors,” Rogers added.

Notably, Rogers has received some key support from establishment Republicans — even though the primary field is not fully set. In a pair of statements released through the National Republican Senatorial Committee, the campaign arm of Senate Republicans, Senate Majority Leader John Thune, R-S.D., and Sen. Tim Scott, R-S.C., who is chairman of the NRSC, both endorsed Rogers.

The Trump administration’s attempt to invoke the Alien Enemies Act to deport alleged members of the Venezuelan gang Tren de Aragua hit another legal roadblock Tuesday with a federal judge in Colorado blocking some removals under the wartime authority.

U.S. District Judge Charlotte Sweeney issued a temporary order Tuesday that prohibits the administration from using the law to deport noncitizens currently within the state of Colorado, further requiring that noncitizens subject to the AEA removal receive at least three weeks’ notice before deportation..

The Trump administration last month touched off a legal battle when it invoked the Alien Enemies Act — an 18th century wartime authority used to remove noncitizens with little-to-no due process — to deport two planeloads of alleged migrant gang members to the CECOT mega-prison in El Salvador by arguing that the Venezuelan gang Tren de Aragua is a “hybrid criminal state” that is invading the United States.

An official with the U.S. Immigration and Customs Enforcement acknowledged that “many” of the men deported on March 15 lack criminal records in the United States — but said that “the lack of specific information about each individual actually highlights the risk they pose” and “demonstrates that they are terrorists with regard to whom we lack a complete profile.”

The U.S. Supreme Court, in a subsequent 5-4 decision, allowed the Trump administration to resume deportations of alleged migrant gang members under the Alien Enemies Act — but said detainees must be given due process to challenge their removal.

The Colorado case is one of several lawsuits challenging the use of the AEA in Colorado, New York, and Texas, in which lawyers have argued that the Trump administration is shortchanging noncitizens by failing to provide them the “reasonable time” promised by the Supreme Court.

Judge Sweeney, in Tuesday’s order, criticized the Trump administration for attempting to remove two men in a manner she said is “deficient and fails to comport with due process.” According to the judge, the notices used by the Trump administration did not provide the men a reasonable amount of time to act on their due process and were only provided in English.

“The Court has grave concerns that Petitioners would be afforded notice that comports with due process to challenge the determination,” she wrote.

The judge also cast doubt on the legitimacy of President Donald Trump’s proclamation invoking the use of the Alien Enemies Act, writing that the plaintiffs were likely to prove that the proclamation violates Immigration and Nationality Act and humanitarian protections.

The Colorado ruling comes as a federal judge in New York is set to hear arguments Tuesday after he temporarily ruled that detained migrants being held in the Southern District of New York could not be deported without due process.

U.S. District Judge Alvin Hellerstein ruled earlier this month that several alleged Venezuelan gang members could not be deported under the AEA without them first receiving notice and an opportunity for a hearing.

Judge Hellerstein, in his temporary order blocking the deportations, suggested his decision was meant to define the parameters of the Supreme Court’s opinion requiring due process be granted.

The relief Hellerstein granted is limited to approximately a dozen migrants currently detained in a few New York counties.

Three federal prosecutors who worked on the corruption case against New York City Mayor Eric Adams resigned Tuesday — while they were on administrative leave — instead of agreeing to “preconditions” on them returning to the office, sending a sharp letter to Deputy Attorney General Todd Blanche and accusing him of pressuring them to falsely “express regret and admit some wrongdoing” in the case.

“The Department placed each of us on administrative leave ostensibly to review our, and the Southern District of New York U.S. Attorney’s Office’s, handling of the Adams case,” the trio of prosecutors assigned to Adams’ case, Celia V. Cohen, Andrew Rohrbach and Derek Wikstrom, wrote to Blanche. “It is now clear that one of the preconditions you have placed on our returning to the Office is that we must express regret and admit some wrongdoing by the Office in connection with the refusal to move to dismiss the case. We will not confess wrongdoing when there was none.”

The three lawyers were part of a group in the Justice Department who refused to sign off on the dismissal of the bribery case against Adams in February. They were placed on administrative leave last month as an investigation played out.

“We have served under Presidents of both parties, advancing their priorities while pursuing justice without fear or favor,” the three prosecutors wrote. “The role of a career prosecutor is not to set policy. But a prosecutor must abide by the oath to uphold the Constitution and laws of the United States and the rules of professional ethics set by the bar and the courts.”

They later added, “Now, the Department has decided that obedience supersedes all else, requiring us to abdicate our legal and ethical obligations in favor of directions from Washington. That is wrong.”

The fallout from acting Deputy Attorney General Emil Bove’s request that the Southern District of New York dismiss charges without prejudice began in mid-February. Danielle Sassoon, then-acting U.S. attorney for the Southern District of New York, resigned from her position Feb. 13 after suggesting DOJ leadership, including Bove, were explicitly aware of a quid pro quo suggested by Adams’ attorneys, saying Adams’ vocal support of President Donald Trump’s immigration policies would be boosted by dismissing the indictment against him.

“Rather than be rewarded, Adams’s advocacy should be called out for what it is: an improper offer of immigration enforcement assistance in exchange for a dismissal of his case,” Sassoon wrote at the time. “Although Mr. Bove disclaimed any intention to exchange leniency in this case for Adams’s assistance in enforcing federal law, that is the nature of the bargain laid bare in Mr. Bove’s memo.”

Five other DOJ officials would join Sassoon in resigning from the office in protest, while at least six top Department of Justice officials refused to sign onto the case’s dismissal, sources told ABC News last month.

Adams was indicted last year in the Southern District of New York on five counts in an alleged long-standing conspiracy connected to improper benefits, illegal campaign contributions and an attempted cover-up. He had pleaded not guilty.

The dismissal paperwork was later signed by an attorney in the Justice Department’s Public Integrity Section, leaving the decision to dismiss the case to a federal judge in New York.

On April 2, Judge Dale Ho officially dismissed the case, however, he did so with prejudice, meaning the charges cannot be revived. The DOJ had asked for the charges to be dismissed without prejudice and said they could be brought against Adams again following the November mayoral election.

But three weeks later, the fallout continued with Tuesday’s letter.

The three prosecutors ended their letter to Blanche: “Serving in the Southern District of New York has been an honor. There is no greater privilege than to work for an institution whose mandate is to do the right thing, the right way, for the right reasons. We will not abandon this principle to keep our jobs. We resign.”

The U.S. Attorney’s Office for the Southern District of New York declined to comment.
