WASHINGTON — Elections in Florida and Wisconsin have become key tests of President Donald Trump’s political standing two months into his second White House term.

The marquee race Tuesday is for a swing seat on the Wisconsin Supreme Court, a technically nonpartisan election that has drawn at least $90 million in spending. Trump and billionaire adviser Elon Musk are backing conservative judge Brad Schimel while progressive billionaires and Democrats support liberal Susan Crawford.

Two Republican-friendly Florida congressional seats could give the GOP some breathing room in the narrowly divided chamber. But Democrats in both districts have far outraised their GOP counterparts, and national Republicans have been publicly concerned in particular about the race to replace Mike Waltz, now Trump’s national security adviser.

Here are the places to watch as the vote results are reported on election night:

In any statewide election in Wisconsin, Democrats tend to win by large margins in the populous counties of Milwaukee and Dane (home of Madison). But the size of that win is usually a big factor in who wins statewide, especially in a close contest.

In 2024, Democratic presidential nominee Kamala Harris carried Milwaukee with 68% of the vote and Dane with 75% while narrowly losing statewide. That same night, Democratic U.S. Sen. Tammy Baldwin ran about 2 percentage points ahead of Harris in both counties and narrowly won reelection.

In 2023, the Democratic Party-backed Supreme Court candidate Janet Protasiewicz received 73% of the vote in Milwaukee and 82% of the vote in Dane and went on to win statewide by an 11-percentage-point margin.

Republicans tend to do well in the suburban Milwaukee counties of Washington, Ozaukee and Waukesha — the so-called “WOW” counties. A strong Republican showing in these counties can help counter the Democratic advantage in urban areas. Republican candidates have carried all three counties in every major statewide election going back to at least 2016.

Republican candidates tend to win Brown County, which is home to Green Bay, but not by huge blowouts. Trump carried the county in all three of his presidential campaigns with between 52% and 53% of the vote.

But since the 2016 election, there have been two Democrats who carried Brown County and went on to win statewide: Tony Evers in his bid for governor in 2018 and more recently Protasiewicz in her 2023 state Supreme Court race.

A Democrat can still win statewide without winning Brown (such as Democrat Joe Biden in 2020, Evers’ reelection in 2022 and all three of Baldwin’s U.S. Senate runs). But if they do carry Brown, it’s probably going to be a rough night for Republicans.

Sauk County, northwest of Madison, is a competitive area in statewide elections that usually ends up supporting the Democratic candidate, albeit by slim margins. It falls somewhere in the middle of Wisconsin’s 72 counties in terms of population, and the margins are usually so small that statewide elections aren’t typically won or lost in Sauk.

Democrats or Democratic-backed candidates had a long winning streak in Sauk, having carried the county in eight of the last 10 major statewide elections. But the two exceptions are notable: Trump carried Sauk in 2016 and 2024, when he won Wisconsin and the White House.

While Sauk won’t likely place a decisive role in Tuesday’s elections, a victory there by a Republican-backed candidate may be a good sign for the party statewide.

Democrats are encouraged by the strong fundraising performances of their nominees to replace Waltz and former Florida Rep. Matt Gaetz, but the special elections take place in two congressional districts that have long been safe Republican territory.

Trump received about 68% of the vote in 2024 in the Florida Panhandle’s 1st Congressional District, slightly outperforming the 66% Gaetz received in his reelection bid. In the 6th Congressional District on the Atlantic coast, Trump received roughly 65% of the vote, just behind the 67% Waltz received in his final House reelection bid.

The four counties that make up the 1st District have voted for Republican presidential candidates almost continually for the past 60 years. Only Walton County went for a Democrat on one occasion since 1960, although all four voted for Democrat-turned-independent candidate George Wallace in 1968. Today, the part of Walton County that falls within the 1st District is the most reliably Republican of the four counties.

Republican presidential candidates have carried all six counties in the 6th District for the last four presidential elections. The Republican winning streak in some of the counties stretches back for decades before that. Lake County, for instance, hasn’t supported a Democrat for president since Franklin Roosevelt in 1944. Trump and Waltz performed best in Putnam County, where they both received about 74% of the vote.

If Democrats manage to pull off upsets in either the 1st or 6th districts, the first indications may be in their best performing counties.

Given the Republican advantage in both districts, the Democrats’ best areas are still places where Republicans performed well. In the 1st District, Trump and Gaetz did comparatively the worst in Escambia County, although they still received 59% and 57% of the county vote, respectively.

In the 6th District, Democrats may do best in Volusia County, where Trump received 58% and Waltz received about 60%. Republican presidential candidates have carried Volusia in the last four elections, but the area used to be more friendly territory for Democrats, who won the county for six consecutive elections from 1992 through 2008.

GREEN BAY, Wis. — GREEN BAY, Wis. (AP) — Elon Musk and his political operatives have tried to shape the closely watched Wisconsin Supreme Court race in ways that are not immediately obvious but could be critical to Tuesday’s outcome.

Musk’s America PAC has sent paid canvassers across Wisconsin since early February, before conservative Brad Schimel advanced in a nonpartisan primary to face liberal Susan Crawford for an open seat on the state’s highest court, where liberal justices hold a 4-3 majority and retirement this year of a liberal justice puts majority control of the court in play.

Over the eight weeks since, canvassers are expected to have reached hundreds of thousands of potential Schimel voters, based on the more than $4.3 million alone that spending records a week before the election showed America PAC had poured into this labor-intensive aspect of the campaign.

“As I travel around the state, I’ve been hearing from quite a few folks who say they’ve got America PAC knocks at their doors,” said Brian Schimming, the state Republican chairman. “And it’s not just in the big areas.”

Though the group has been aggressive in GOP-heavy Waukesha County in suburban Milwaukee, Schimming and others report hearing that America PAC canvassers have appeared in Racine County, a blue-collar area south of Milwaukee and areas such as Sauk County northwest of Madison.

“They have been on this more than anybody,” Schimming said.

Musk played up the stakes at an America PAC event Sunday night in Green Bay, saying Schimel was in danger of losing and calling for a movement to “dragnet the state.”

“Everybody’s going to mobilize everywhere like crazy for the next 48 hours,” he said. “And I think this will be important for the future of civilization. It’s that significant. You don’t hear me saying that very often. It’s a big deal.”

He encouraged attendees to sign up at America PAC’s website to be a “block captain,” for which they could earn $20 for knocking on doors in their neighborhoods and uploading a photo as proof.

“It’s … thumbs up and hold a picture of Judge Schimel. And that’s it, and you get $20,” he said.

Though America PAC declined to discuss details of its work, the group’s commitment confirms Musk’s uniquely powerful role in Republican politics as someone working closely with President Donald Trump and willing to spend tens of millions of dollars to boost Trump and his allies.

During the 2024 presidential election, Musk, the world’s richest person, committed more than $200 million to America PAC’s work on Trump’s behalf in the seven most competitive states, including Wisconsin, where Trump won by fewer than 30,000 votes, less than a percentage point.

The Wisconsin Supreme Court comes as the court is expected to rule on abortion rights, congressional redistricting, union power and voting rules that could affect the 2026 midterms and the 2028 presidential election. Musk and America PAC are trying to elevate Schimel, who has attached himself publicly to Trump and Musk.

America PAC representatives were working the crowd Friday at a Schimel rally in Beaver Dam, northeast of Madison. They were seeking petition signatures to oppose “activist judges.” The political action committee promised $100 for each Wisconsin voter who signed the petition and another $100 for each signer they referred.

Musk has become a Democratic target and the center of the party’s messaging against Schimel. Crawford, who is backed by liberal billionaires including George Soros and Illinois Gov. JB Pritzker, referred to her opponent in their debate as “Elon Schimel.”

Many standing nearby waved signs in protest to Musk.

“Musk Hates Judges Who Do Their Job!,” said one man’s cardboard sign, held over his head. The man next to him held one that simply said, “NO DOGE,” referring to the Department of Government Efficiency, Trump’s government cost-cutting effort, which Musk directs.

Musk drew widespread attention with the Sunday rally in Green Bay and his $1 million giveaways to people who sign the petition decrying judicial activism. Groups linked to Musk have spent more than $17 million to support Schimel in what’s become the most expensive judicial race in American history.

A significant portion of that money is going into the tedious but critical work of voter turnout.

As of one week before the election, America PAC had spent $4.3 million on canvassing alone, according to figures compiled by the Wisconsin Democracy Campaign, a nonprofit, nonpartisan organization that advocates for transparency in campaign spending.

Americans for Prosperity, a group founded by anti-tax billionaire brothers Charles and David Koch, is also canvassing in the supreme court race and also was active in Wisconsin during the 2024 campaign. But the group also was a distant second in the Supreme Court race, having spent only about a sixth of America PAC — $712,000 — on canvassing, according to the Wisconsin Democracy Campaign.

While the millions America PAC has spent on canvassing are far beyond what other groups have committed, America PAC also had spent as of last week at least another $4 million on mail, printing, online advertising, phone-banking, text messaging and other organizing costs, also far ahead of other groups.

The group was canvassing this month in Sauk County, where the presidential candidate who took the state has won in five straight elections.

Trump last year won Sauk — split between Democratic-leaning areas closer to Madison and a more conservative rural northwest — by 626 votes after Democrat Joe Biden won the county by 615 votes in 2020.

America PAC canvassers were in Sauk County knocking on doors last fall, trying to reach voters who had voted Republican in the past but had not been reliably active.

“America PAC is in our neck of the woods,” said Jerry Helmer, the county’s Republican chairman. “They were up knocking on doors in the Wisconsin Dells this month. America PAC has been doing a really good job in our area. They are just killing it in Sauk County.”

LOS ANGELES — Former Vice President Kamala Harris stepped on the NAACP Image Awards stage Saturday night with a sobering message, calling the civil rights organization a pillar of the Black community and urging people to stay resilient and hold onto their faith during the tenure of President Donald Trump.

“While we have no illusions about what we are up against in this chapter in our American story, this chapter will be written not simply by whoever occupies the oval office nor by the wealthiest among us,” Harris said after receiving the NAACP’s Chairman’s Award. “The American story will be written by you. Written by us. By we the people.”

The 56th annual Image Awards was held at the Pasadena Civic Auditorium in the Los Angeles area.

Harris, defeated by Trump in last year’s presidential election, was the first woman and the first person of color to serve as vice president. She had previously been a U.S. senator from California and the state’s attorney general.

In her first major public appearance since leaving office, Harris did not reference her election loss or Trump’s actions since entering the Oval Office, although Trump mocked her earlier in the day at the Conservative Political Action Conference.

Harris spoke about eternal vigilance, the price of liberty, staying alert, seeking the truth and America’s future.

“Some see the flames on our horizons, the rising waters in our cities, the shadows gathering over our democracy and ask ‘What do we do now?’” Harris said. “But we know exactly what to do, because we have done it before. And we will do it again. We use our power. We organize, mobilize. We educate. We advocate. Our power has never come from having an easy path.”

Other winners of the Chairman’s prize have included former President Barack Obama, the late Rep. John Lewis and the late actor Ruby Dee.

Harris was honored during the ceremony along with the Wayans family. The family was inducted into the NAACP Image Awards Hall of Fame in recognition of pioneering contributions to film, TV, sketch and stand-up comedy that have shaped Hollywood for decades.

Keenen Ivory Wayans, Damon Wayans Sr., Marlon Wayans, Shawn Wayans, Kim Wayans and Damon Wayans Jr. each were recognized.

Marlon Wayans, whose guest appearance on Peacock’s “Bel-Air” was up for an NAACP award, shared how Keenen Ivory Wayans sparked the family’s rise.

“He raised us all like Jedis,” he said. “We wouldn’t be here if it wasn’t for our big brother.”

Marlon Wayans joked that when his brother told their mom he was leaving college for comedy, she said, ”Boy, I’ve known you your whole life, and you ain’t never said nothing funny. That’s the funniest thing you’ve said.”

The crowd erupted in laughter, a fitting tribute to a family that has kept audiences laughing for more than three decades.

The family has a long list of credits. Keenen Ivory Wayans created the sketch comedy series “In Living Color” in 1990 and directed the 2000 slasher spoof “Scary Movie,” which was written by Marlon Wayans and Shawn Wayans, who also wrote and starred in “White Chicks” in 2004. Damon Wayan’s had a starring role in the 1995 comedy “Major Payne,” and currently co-stars with son Damon Wayans Jr. in the CBS sitcom “Poppa’s House,” which was nominated for an NAACP Award. The pair also were nominated for their acting on the show.

Damon Wayans Jr. has acted in two of the most critically acclaimed comedies in recent years: “Happy Endings” and “New Girl.” Kim Wayans, a comedian, actor and director, also received praise for her work in the 2011 drama “Pariah.”

Keke Palmer expressed her surprise after her name was called as winner of the coveted entertainment of the year.

“Oh my gosh. Guys, I didn’t think I was going to win,” said Palmer, who paid homage to fellow nominee Cynthia Erivo’s Oscar-nominated performance in “Wicked.”

Palmer starred in the buddy comedy “One of Them Days,” which debuted No. 1 at the box office last month. She also won an Emmy for her hosting efforts on NBC’s “Password.”

“It’s such an amazing category to be in with all these people,” Palmer said. “It’s a beautiful night. It’s Black History Month, y’all. It’s so important we all come here together and celebrate one another with one another.”

Other nominees included Kendrick Lamar, Kevin Hart and Shannon Sharpe.

Image Awards host Deon Cole honored residents of the nearby Altadena neighborhood who were affected by January’s devastating Los Angeles-area wildfires.

A video of the fire devastation played before actor Morris Chestnut took the stage.

“Homes were lost, stores destroyed, countless lives shattered and over two dozens souls gone forever,” said Chestnut, a Los Angeles native who referenced impacted areas such as Altadena, the Pacific Palisades and Malibu.

“But what was not lost is the spirit of our community,” said Chestnut, who noted 22 Altadena residents attended the show on Saturday. Many in the audience stood and applauded.

Cole shifted tone and brightened the mood with a comedic prayer for Kanye West’s wife to find more clothes after her barely-there Grammys look and for Shannon Sharpe to finally size up his T-shirts.

The opening act was a lead-up to the evening’s first award: Queen Latifah as best actress in a drama series for her role in “The Equalizer.”

Dave Chappelle was honored with the President’s Award for his “thought-provoking humor.”

Accepting the award, Chappelle talked about the NAACP’s push against negative portrayals of Black people in media and the importance of representation.

“Every opportunity we get, we just keep chipping away at this monster of a machine,” he said.

Past recipients of the President’s Award include Jay-Z, Lauryn Hill, Usher, Rihanna and John Legend.

NEW YORK — Former Vice President Kamala Harris is to receive the NAACP ‘s Chairman’s Award during the civil rights organization’s Image Awards ceremony this weekend.

Harris, defeated by Donald Trump in last year’s presidential election, was the first woman and the first person of color to serve as vice president. She had previously been a U.S. senator from California and the state’s attorney general.

“Vice President Kamala Harris is more than a leader — she is a force of change, driven by an unwavering passion to shape a brighter, more equitable future. It is with great honor that we present her with the Chairman’s Award at this year’s NAACP Image Awards, celebrating her relentless dedication to justice, equality, and the betterment of our society,” Leon W. Russell, chair of the NAACP’s national board of directors, said in a statement Monday.

Other winners of the Chairman’s prize have included former President Barack Obama, the late Rep. John Lewis and the late actor Ruby Dee.

The Image Awards, co-presented by the NAACP and BET, will take place Saturday at the Pasadena Civic Auditorium in California. Categories range from entertainer of the year to best movie to outstanding work of poetry.

President Joe Biden is decrying what he calls an “unrelenting effort” to downplay a mob of Donald Trump supporters overrunning the U.S. Capitol in an attempt to block certification of the 2020 election — seeking to contrast that day’s chaos with what he promises will be an orderly transition returning Trump to power for a second term.

In an opinion piece published Sunday in The Washington Post, Biden recalled Jan. 6, 2021, writing that “violent insurrectionists attacked the Capitol.”

“We should be proud that our democracy withstood this assault,” Biden wrote. “And we should be glad we will not see such a shameful attack again this year.”

Congress will convene amid snow in Washington on Monday to certify Trump’s victory in November’s election — in a session presided over by the candidate he defeated, Vice President Kamala Harris. No violence, or even procedural objections, are expected this time, marking a return to a U.S. tradition that launches the peaceful transfer of presidential power.

That’s despite Trump continuing to deny that he lost to Biden in 2020, already musing publicly about staying beyond the Constitution’s two-term White House limit, and promising to pardon some of the more than 1,250 people who have pleaded guilty or were convicted of crimes for the Capitol siege.

In his opinion piece, Biden says of the certification process, “After what we all witnessed on Jan. 6, 2021, we know we can never again take it for granted.” He doesn’t mention Trump directly but says “an unrelenting effort has been underway to rewrite — even erase — the history of that day.”

“To tell us we didn’t see what we all saw with our own eyes,” Biden wrote. “We cannot allow the truth to be lost.”

He vowed that the “election will be certified peacefully. I have invited the incoming president to the White House on the morning of Jan. 20, and I will be present for his inauguration that afternoon,” even though Trump skipped Biden’s inauguration in 2021.

“But on this day, we cannot forget,” Biden added. “We should commit to remembering Jan. 6, 2021, every year. To remember it as a day when our democracy was put to the test and prevailed. To remember that democracy — even in America — is never guaranteed.”

The published piece followed Biden telling reporters at the White House earlier Sunday that the history of what occurred on Jan. 6, 2021, “should not be rewritten” and adding, “I don’t think it should be forgotten.”

Biden spent much of 2024 warning voters that Trump was a serious threat to the nation’s democracy. And this past week, the president awarded the Presidential Citizens Medal to Liz Cheney and Bennie Thompson, leaders of the congressional investigation into the Capitol riot.

As he did with his opinion piece, Biden used his Sunday comments to reporters to stress that his administration is overseeing a peaceful handover of power — unlike the last one.

”I’ve reached out to make sure the smooth transition,” Biden said of Trump’s incoming administration. “We’ve got to get back to basic, normal transfer of power.”

Asked if he still viewed his soon-to-be successor in the White House as a threat to democracy, Biden responded, “I think what he did was a genuine threat to democracy. I’m hopeful we’re beyond that now.”

This Jan. 6 won’t be the same.

Four years ago, then-President Donald Trump urged supporters to head to the Capitol to protest Congress’ certification of Democrat Joe Biden’s victory in the 2020 election.

“Will be wild!” Trump promised on Twitter a few weeks before Jan. 6, 2021. And it was.

Trump gave a vitriolic speech to thousands of people gathered at the Ellipse behind the White House, after which many marched to the Capitol and stormed the building in an attempt to stop the previously routine final step in formalizing the winner of the presidential election. Even after the rioters dispersed, eight Republicans in the Senate and 139 in the House voted against ratifying Biden’s win in certain swing states, despite no evidence of problems or wrongdoing that could have affected the outcome.

This year, the only turbulence preceding the quadrennial ratification of the presidential election resulted from House Republicans fighting among themselves over who should be speaker.

“There will be no violence. There will be no attempt to mount an insurrection against the Constitution,” said Rep. Jamie Raskin, D-Md. “It will be a lot more like what we’ve seen for the rest of American history.”

The last time, Trump urged his vice president, Mike Pence, who was presiding over the certification, to intervene to keep him in the White House. This time, Vice President Kamala Harris, the Democratic nominee against Trump, has acknowledged her loss and isn’t expected to try to change long-established procedures for certifying the election. No other prominent Democrat has urged the party to contest Trump’s win, either.

Congress also has since updated the law that governs the proceeding, clarifying the process in the states and specifying the vice president’s role as merely ministerial.

After the 2020 election, many Republicans contended there were signs of massive voter fraud that made it impossible to confirm Biden’s victory, even though there has never been any indication of widespread fraud. After Trump won this November, many of those same Republicans had no such objections, saying they trusted the accuracy of the vote count. It was a change in sentiment shared by Republicans across the country.

“As citizens, we should all be happy when it goes smoothly,” said Edward Foley, a law professor at Ohio State University. “It’s always better not to have major contestation over elections, especially when there isn’t a reasonable position for it.”

Still, the calm may be illusory.

Trump and Republicans had signaled that if had Harris won, they were prepared to contest her victory. Vice President-elect JD Vance, as an Ohio senator, argued that Pence should have acted to overturn Biden’s election.

Vance himself is set to be in the position to preside over the next significant Jan. 6 — in 2029, when Congress will be scheduled to accept the electoral votes for the winner of the 2028 presidential election.

“The most dangerous January 6 event is not January 6, 2025. It’s January 6, 2029, and beyond,” said David Weinberg of Protect Democracy, which defends against what it terms authoritarian threats to the country. “It creates an enormous problem when only one side of the aisle stands down when it loses an election.”

The Constitution lays out some basic steps required to choose the next president, and congressional legislation has filled in the procedural blanks. After states choose their winning candidates on Election Day, electors who are pledged to vote for those candidates meet as the Electoral College and formally cast their votes for president.

Congress then tallies the votes on Jan. 6 in a joint session presided over by the vice president to formally determine who’s won a majority of the Electoral College.

In 2021, Trump pushed for Pence not to read out the tallies from swing states that Biden won, thereby forcing Congress to vote to accept a list of states where Trump won the majority of the Electoral College. That ploy was something that Pence and numerous legal scholars said was an unconstitutional act.

A year later, Biden signed the bipartisan bill that updated the 1887 law governing the joint session to make clear the vice president needs to read all of the state tallies. The Electoral Count Reform Act also makes it harder to object to the congressional vote.

Still, many House Republicans remain opposed to that law.

House Speaker Mike Johnson, R-La., was a prime supporter of Trump’s efforts to overturn his 2020 loss and had not ruled out trying to change the election outcome if Trump lost in November. Republicans spent the final weeks of the election contending Democrats would do the same if Trump won, citing a push by some to disqualify the former president from the ballot under the Constitution’s once-obscure “insurrection clause.” That effort ultimately was rebuffed by the U.S. Supreme Court.

Republicans say the size of Trump’s election victory is why there is no potential unrest. He won the presidency by about 230,000 votes in the swing states and the popular vote by 1.5 percentage points after losing by about 44,000 votes in the swing states and 4.5 percentage points nationwide in 2020.

“This time, I think the win was so decisive that it just — for good or ill depending on which side you’re on — it’s stifled most of that,” said Arizona Rep. Andy Biggs, a Republican who led the objections on Jan. 6, 2021, over groundless allegations of voter fraud.

Foley, author of the book “Ballot Battles” about election challenges in U.S. history, advised Congress on changes to the law governing the joint session and its certification of the presidential election. He said he hoped the 2024 election marks the end of groundless challenges to congressional certification, even though the candidate who spearheaded the last challenge won.

That’s because Trump has said he won’t run again and is constitutionally barred from seeking a third term. Foley noted that, in 2022, a number of Republicans tried to mimic Trump’s distrust of election results and widely lost in swing states. Election denial, he said, may not be viable if not attached to Trump.

“As Trump will never be a candidate again,” Foley said, “I hope this is beyond us.”

FORT LAUDERDALE, Fla. — President-elect Donald Trump promised on Tuesday to “vigorously pursue” capital punishment after President Joe Biden commuted the sentences of most people on federal death row partly to stop Trump from pushing forward their executions.

Trump criticized Biden’s decision on Monday to change the sentences of 37 of the 40 condemned people to life in prison without parole, arguing that it was senseless and insulted the families of their victims. Biden said converting their punishments to life imprisonment was consistent with the moratorium imposed on federal executions in cases other than terrorism and hate-motivated mass murder.

“Joe Biden just commuted the Death Sentence on 37 of the worst killers in our Country,” he wrote on his social media site. “When you hear the acts of each, you won’t believe that he did this. Makes no sense. Relatives and friends are further devastated. They can’t believe this is happening!”

Presidents historically have no involvement in dictating or recommending the punishments that federal prosecutors seek for defendants in criminal cases, though Trump has long sought more direct control over the Justice Department’s operations. The president-elect wrote that he would direct the department to pursue the death penalty “as soon as I am inaugurated,” but was vague on what specific actions he may take and said they would be in cases of “violent rapists, murderers, and monsters.”

He highlighted the cases of two men who were on federal death row for slaying a woman and a girl, had admitted to killing more and had their sentences commuted by Biden.

On the campaign trail, Trump often called for expanding the federal death penalty — including for those who kill police officers, those convicted of drug and human trafficking, and migrants who kill U.S. citizens.

“Trump has been fairly consistent in wanting to sort of say that he thinks the death penalty is an important tool and he wants to use it,” said Douglas Berman, an expert on sentencing at Ohio State University’s law school. “But whether practically any of that can happen, either under existing law or other laws, is a heavy lift.”

Berman said Trump’s statement at this point seems to be just a response to Biden’s commutation.

“I’m inclined to think it’s still in sort of more the rhetoric phase. Just, ‘don’t worry. The new sheriff is coming. I like the death penalty,’” he said.

Most Americans have historically supported the death penalty for people convicted of murder, according to decades of annual polling by Gallup, but support has declined over the past few decades. About half of Americans were in favor in an October poll, while roughly 7 in 10 Americans backed capital punishment for murderers in 2007.

Before Biden’s commutation, there were 40 federal death row inmates compared with more than 2,000 who have been sentenced to death by states.

“The reality is all of these crimes are typically handled by the states,” Berman said.

A question is whether the Trump administration would try to take over some state murder cases, such as those related to drug trafficking or smuggling. He could also attempt to take cases from states that have abolished the death penalty.

Berman said Trump’s statement, along with some recent actions by states, may present an effort to get the Supreme Court to reconsider a precedent that considers the death penalty disproportionate punishment for rape.

“That would literally take decades to unfold. It’s not something that is going to happen overnight,” Berman said.

Before one of Trump’s rallies on Aug. 20, his prepared remarks released to the media said he would announce he would ask for the death penalty for child rapists and child traffickers. But Trump never delivered the line.

One of the men Trump highlighted on Tuesday was ex-Marine Jorge Avila Torrez, who was sentenced to death for killing a sailor in Virginia and later pleaded guilty to the fatal stabbing of an 8-year-old and a 9-year-old girl in a suburban Chicago park several years before.

The other man, Thomas Steven Sanders, was sentenced to death for the kidnapping and slaying of a 12-year-old girl in Louisiana, days after shooting the girl’s mother in a wildlife park in Arizona. Court records show he admitted to both killings.

Some families of victims expressed anger with Biden’s decision, but the president had faced pressure from advocacy groups urging him to make it more difficult for Trump to increase the use of capital punishment for federal inmates. The ACLU and the U.S. Conference of Catholic Bishops were some of the groups that applauded the decision.

Biden left three federal inmates to face execution. They are Dylann Roof, who carried out the 2015 racist slayings of nine Black members of Mother Emanuel AME Church in Charleston, South Carolina; 2013 Boston Marathon bomber Dzhokhar Tsarnaev; and Robert Bowers, who fatally shot 11 congregants at Pittsburgh’s Tree of Life Synagogue in 2018, the deadliest antisemitic attack in U.S history. _______

WASHINGTON — WASHINGTON (AP) — Donald Trump doesn’t think much of Joe Biden’s foreign policy record. The Republican president-elect frequently casts the outgoing Democratic president as a feckless leader who shredded American credibility around the world during his four-year term.

But a funny thing happened on Trump’s way back to the White House: The Biden and Trump national security teams have come to an understanding that they have no choice but to work together as conflicts in Gaza, Syria and Ukraine have left a significant swath of the world on a knife’s edge.

It’s not clear how much common ground those teams have found as they navigate crises that threaten to cause more global upheaval as Trump prepares to settle back into the White House on Jan. 20, 2025.

“There is a deep conviction on the part of the incoming national security team that we are dealing with … and on our part, directed from President Biden, that it is our job, on behalf of the American people, to make sure this is a smooth transition,” Biden’s national security adviser Jake Sullivan said during a weekend appearance at a forum in California. “And we are committed to discharging that duty as relentlessly and faithfully as we possibly can.”

To be certain, Trump and his allies haven’t let up on their criticism of Biden, putting the blame squarely on the shoulders of Biden and Democrats for the series of crises around the globe.

The president-elect says Biden is responsible for the wars in Gaza and Ukraine, arguing that policies under his watch led to Hamas and Russia becoming emboldened. And shortly before Syria’s Bashar al-Assad’s government collapsed last week, Trump blamed Biden’s old boss, former President Barack Obama, for failing to enforce his own “red line” in 2013 after Assad deployed chemical weapons that killed hundreds of civilians, and laying the groundwork for Islamic militants to establish a beachhead in the country.

But amid the hectoring of Biden, Trump team officials acknowledge that the Biden White House has worked diligently to keep Trump’s circle apprised and help ensure there is a smooth handoff on national security matters.

“For our adversaries out there that think this is a time of opportunity that they can play one administration off the other, they’re wrong, and we are — we are hand in glove,” Mike Waltz, Trump’s pick for national security adviser, said in a Fox News interview last month. “We are one team with the United States in this transition.”

While Trump rarely has a good word for the Democratic administration, there’s an appreciation in Trump world of how the Biden White House has gone about sharing critical national security information, according to a Trump transition official who was not authorized to comment publicly.

The coordination is precisely how lawmakers intended for incoming and outgoing administrations to conduct themselves during a handover when they bolstered federal support for transitions. It’s already the most substantive handoff process since 2009, aides to Biden and Trump acknowledged, surpassing Trump’s chaotic first takeover in 2017 and his wide refusal to cooperate with the incoming Biden team in 2021.

Trump’s pick to serve as special envoy to the Middle East, Florida real estate developer Steve Witkoff, consulted with Biden administration officials as he recently traveled to Mideast to meet with Israeli Prime Minister Benjamin Netanyahu and Qatar’s Prime Minister Sheikh Mohammed bin Abdulrahman Al Thani, according to a U.S. official who was not authorized to comment publicly about the sensitive talks and spoke on condition of anonymity.

Sullivan, who was to travel to Israel on Wednesday for talks with Netanyahu, has in turn kept Waltz in the loop about the Biden administration’s efforts at getting a ceasefire and hostage deal in Gaza before Trump’s inauguration.

Biden administration officials say that the two national security teams have also closely coordinated on Ukraine and Syria, though they have provided scant detail on what that coordination has looked like.

“Let me put it this way: Nothing that we’re doing and nothing that we’re saying are coming as a surprise to the incoming team,” White House national security spokesman John Kirby said. “They will decide for themselves what policies they might want to keep in place, what approaches they might want to continue and which ones they won’t.”

Trump made clear during his campaign that he would move to end the war in Ukraine quickly once he came to office. He called on Russian leader Vladimir Putin earlier this week to act to reach an immediate ceasefire with Ukraine.

But the Biden White House has begun gently — and publicly — making the case for how continued support for Ukraine lines up with Trump’s priorities.

On Saturday, Sullivan pointed to comments made by Trump on social media to buttress the case that Biden’s push for continued support of Ukraine falls in line with the incoming president’s thinking.

Trump earlier that day had noted that Assad’s rule was collapsing because Russia “lost all interest in Syria because of Ukraine, where close to 600,000 Russian soldiers lay wounded or dead, in a war that should never have started, and could go on forever.”

“Russia and Iran are in a weakened state right now, one because of Ukraine and a bad economy, the other because of Israel and its fighting success,” Trump said in the posting on Truth Social.

Sullivan underscored that Biden and Trump are in agreement that there should be no American boots on the ground in Syria and that the war in Ukraine was a major factor in Assad’s fall.

“I was a little bit struck by it — earlier in the post, he said part of the reason this is happening is because of Russia’s war against Ukraine,” Sullivan said of Trump. “And I think he even referenced the sheer scale of the casualties that Russia has suffered in Ukraine, and for that reason, they’re not in a position to defend their client, Assad. And on that point, we’re in vigorous agreement.”

Two days later in Washington, Sullivan made the case that Trump should bolster the little-known U.S. International Development Finance Corporation that was created during the Republican’s first term.

The push for reauthorizing the foreign aid agency comes as Trump has promised to make massive cuts to the federal bureaucracy.

Trump signed into law the agency’s authority — tucked into a five-year reauthorization of the Federal Aviation Administration — to provide $60 billion in loans, loan guarantees and insurance to companies in developing nations.

Sullivan called the agency an effective tool for private-public partnerships, before allowing that “maybe I shouldn’t be the one” making the case “since I’m leaving, but I will give my advice anyway.”

“It was created as we’ve all noted, under the Trump administration,” Sullivan said in remarks at the agency’s annual conference. “It has been strengthened under the Biden administration. And as we look to DFC reauthorization next year, it has to remain a bipartisan priority.”

After Assad’s government fell, the Biden administration issued a warning to Iran not to speed up its nuclear program after one of its closest allies was toppled, declaring “that’ll never happen on our watch.” The U.S. official, who spoke on the condition of anonymity to discuss the sensitive topic, hinted at coordination on the matter with the Trump team.

The official said there had been “good discussions” with the incoming administration on the matter and there was an expectation the same policy would carry over.

Biden has also approved a new national security memorandum that is meant to serve as a road map for the incoming Trump administration as it looks to counter growing cooperation between China, Iran, North Korea and Russia, the White House announced Wednesday.

Biden administration officials began developing the guidance this summer. It was shaped to be a document that could help the next administration build its approach from Day 1 on how it will go about dealing with the tightening relationships between the United States’ most prominent adversaries and competitors, according to two other senior administration officials.

One of those officials, who spoke on the condition of anonymity under ground rules set by the White House, sought to assure the incoming Trump team that the Biden White House effort “isn’t trying to box them in or tilt them toward one policy option or another.”

Instead, the official said, it’s about helping the next administration build “capacity” as it shapes its policies on some the most difficult foreign policies it will face.

Women will for the first time make up a majority of state legislators in Colorado and New Mexico next year, but at least 13 states saw losses in female representation after the November election, according to a count released Thursday by the Rutgers Center for American Women and Politics.

While women will fill a record number of state legislative seats in 2025, the overall uptick will be slight, filling just over third of legislative seats. Races in some states are still being called.

“We certainly would like to see a faster rate of change and more significant increases in each election cycle to get us to a place where parity in state legislatures is less novel and more normal,” said Kelly Dittmar, director of research at the CAWP, which is a unit of the Eagleton Institute of Politics at Rutgers University.

As of Wednesday, at least 2,450 women will serve in state legislatures, representing 33.2% of the seats nationwide. The previous record was set in 2024 with 2,431 women, according to the CAWP.

The number of Republican women, at least 851, will break the previous record of 815 state lawmakers set in 2024.

“But still, Republican women are very underrepresented compared to Democratic women,” Debbie Walsh, director of the CAWP, said.

By the most recent count, 19 states will have increased the number of women in their state legislatures, according to the CAWP. The most notable increases were in New Mexico and Colorado where women will for the first time make up a majority of lawmakers.

In New Mexico, voters sent an 11 additional women to the chambers. Colorado had previously attained gender parity in 2023 and is set to tip over to a slight female majority in the upcoming year.

The states follow Nevada, which was the first in the country to see a female majority in the legislature following elections in 2018. Next year, women will make up almost 62% of state lawmakers in Nevada, far exceeding parity.

Women in California’s Senate will make up the chamber’s majority for the first time in 2025 as well. Women also made notable gains in South Dakota, increasing its total number by at least nine.

At least thirteen states emerged from the election with fewer female lawmakers than before, with the most significant loss occurring in South Carolina.

Earlier this year, the only three Republican women in the South Carolina Senate lost their primaries after they stopped a total abortion ban from passing. Next year, only two women, who are Democrats, will be in the 46-member Senate.

No other state in the country will have fewer women in its upper chamber, according to the CAWP. Women make up 55% of the state’s registered voters.

Half the members in the GOP dominated state were elected in 2012 or before, so it will likely be the 2040s before any Republican woman elected in the future can rise to leadership or a committee chairmanship in the chamber, which doles out leadership positions based on seniority.

A net loss of five women in the legislature means they will make up only about 13% of South Carolina’s lawmakers, making the state the second lowest in the country for female representation. Only West Virginia has a smaller proportion of women in the legislature.

West Virginia stands to lose one more women from its legislative ranks, furthering its representation problem in the legislature where women will make up just 11% of lawmakers.

Many women, lawmakers and experts say that women’s voices are needed in discussions on policy especially at a time when state government is at its most powerful in decades.

Walsh, director of the CAWP, said the new changes expected from the Trump administration will turn even more policy and regulation to the states. The experiences and perspectives women offer will be increasingly needed, she said, especially on topics related to reproductive rights, healthcare, education and childcare.

“The states may have to pick up where the federal government may, in fact, be walking away,” Walsh said. “And so who serves in those institutions is more important now than ever.”
